Welcome to CINCH Capital LLC. By accessing our website or purchasing our services, you agree to the following Terms of Service.

1. Nature of Services

CINCH Capital LLC provides independent real estate consulting and performance audit services. Our services consist of structured evaluations, documentation review, communication analysis, and professional reporting regarding property management responsiveness and operational performance.

CINCH Capital LLC does not provide legal advice, regulatory enforcement, mediation, arbitration, or legal representation. No attorney-client relationship is formed by using our services.

All audit findings are based on the information provided by the client and/or publicly available data and are delivered for informational and evaluative purposes only.

2. No Guarantee of Outcome

CINCH Capital LLC does not guarantee:

Management company response or action
Dispute resolution
Fee reversals or service changes
Regulatory enforcement
Legal remedies
Our services provide professional evaluation and documentation only.

3. Digital Service Delivery

All services are delivered digitally unless otherwise agreed in writing.

Clients agree that:

Communication will primarily occur via email
Reports will be delivered electronically
Digital signatures are valid and binding
CINCH Capital LLC is not responsible for email delivery failures caused by client-side technical issues.

4. Payment Terms

All payments are due in full at the time of service initiation unless otherwise stated.

Payments are processed through third-party payment processors (e.g., Stripe, GoDaddy Payments, or other providers). CINCH Capital LLC does not store or process credit card information directly.

Clients agree that all fees are earned upon commencement of the audit process.

5. Refund Policy

Due to the nature of consulting and professional services, fees are generally non-refundable once work has commenced.

If a cancellation request is submitted prior to audit initiation, a partial refund may be issued at CINCH Capital’s discretion, minus processing fees.

No refunds will be issued after a report has been delivered.

6. Client Responsibilities

Clients agree to provide accurate and complete information necessary to conduct the audit.

CINCH Capital LLC is not responsible for inaccuracies resulting from incomplete or misleading information provided by the client.

7. Confidentiality

CINCH Capital LLC will maintain client confidentiality and will not disclose identifying client information without written consent, except where required by law.

Clients acknowledge that audit findings may reference third-party entities in a factual and evaluative manner.

8. Limitation of Liability

To the fullest extent permitted by law, CINCH Capital LLC shall not be liable for:

Indirect, incidental, or consequential damages
Lost opportunities or financial losses
Management retaliation or third-party actions
Disputes arising between client and third parties
Total liability shall not exceed the amount paid for the specific service purchased.

9. Independent Contractor Status

CINCH Capital LLC operates as an independent consulting firm and is not affiliated with any HOA, property management company, regulatory authority, or government agency.

10. Intellectual Property

All reports, templates, methodologies, and materials produced by CINCH Capital LLC remain the intellectual property of the company.

Clients may use reports for personal or internal purposes but may not reproduce, distribute, or commercially exploit materials without written permission.

11. Governing Law

These Terms of Service shall be governed by the laws of the State of Georgia, without regard to conflict of law principles.

12. Modifications

CINCH Capital LLC reserves the right to update these Terms of Service at any time. Continued use of services constitutes acceptance of updated terms.
